Flower Preservation Contract

BrookesForeverFlowers (Brooke O’Diear) specializes in preserving flowers and other botanical materials in resin, providing a unique and artistic way to commemorate special occasions. The Client desires to engage the Provider's services for the preservation of their flowers in resin.

NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereto agree as follows:

1. SERVICES:

1.2 The Client acknowledges that the preservation process may alter the appearance of the Items to some extent and agrees to accept the final product as is.

1. Acknowledgment of Hand-Crafted Product

1.1 Client acknowledges that each hand-crafted product produced by BrookesForeverFlowers  will be unique and not will not be the exact same as the original bouquet.

1.2 Client acknowledges that flowers undergo changes in the preservation process, including changes in color.

1.3 Client acknowledges that resin may yellow or amber over time and that even under optimal conditions, this process is natural, for which BFF assumes no liability.

3. No Refunds

Client acknowledges and agrees that there are no refunds and BrookesForeverflowers (Brooke O’Diear) is free from any liability or legal action arising from the purchase or use of its products.

4. Severability

If any provision of this contract is found to be ineffective or unenforceable for any reason, such provision shall be fully severable, and this contract shall be construed and enforced 

4. 2. Limitation of Liability

2.1 Client acknowledges and agrees that BFF is not liable for any injuries sustained in relation to the product.

2.2 BFF is not responsible for lost or damaged products due to nature  affecting BFF, including products lost or damaged in transit or weather conditions. In no event shall  Brookesforeverflowers owner be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to this Agreement.

9. POTENTIAL IMPERFECTIONS:

9.1 The Client acknowledges that during the preservation process, bruising on petals may result in translucent spots on the preserved Items.

9.2 The Client further acknowledges that flowers undergo color changes during the drying process, and as a result, the final color of the preserved Items may differ from their original appearance.

9.3 The Client understands that resin is a handmade material and may contain bubbles or other imperfections. While the Provider will make reasonable efforts to minimize such imperfections, they are inherent to the nature of handmade art.

10. ACCEPTANCE:

10.1 The Client agrees that minor imperfections, including but not limited to bubbles, slight color variations, and translucent spots resulting from bruising, or resin imperfections shall not constitute grounds for rejection of the preserved Items.

11. INDEMNIFICATION:

11.1 The Client agrees to indemnify and hold harmless the Provider from and against any claims, damages, liabilities, costs, and expenses arising out of or relating to any imperfections or variations in the preserved Items.
